As a service provider, DataDistinct Solutions, LLC., acting through its CoinCalcu division, (“CoinCalcu”) is concerned about privacy issues and we want end users to understand our practices in connection with information that we collect through CoinCalcu’s application website located at www.coincalcu.com or at such alternate site that CoinCalcu identifies and any other CoinCalcu service that links to this Data Use Statement. As between you and CoinCalcu, this Data Use Statement is our sole and exclusive privacy statement for the Application (as defined below), and it applies together with the Application Terms of Use and any other applicable agreements under which we provide you access to the Application (collectively, the “Agreements”). This Data Use Statement does not apply to any other CoinCalcu offering or site, including without limitation the blackdiamondperformancereporting.com website or the CoinCalcu Community or any other general CoinCalcu website(s).

Definitions

“Account Data,” means the Investor-specific account data, including or pertaining to, without limitation, transactions, positions, and other Personal Information provided or authorized, whether directly or indirectly, by an Investor to be made available to CoinCalcu in connection with the provision of Application.

“Application,” means CoinCalcu’s proprietary service and system provided by CoinCalcu over the Internet that permits customers and/or end users to have access to Data and any functionality licensed under an applicable ordering agreement. Application shall include the services (as ordered under an ordering agreement), update(s), and client software, if any.

“Firm,” means the firm on whose behalf CoinCalcu is making Application available to you.

“Personal Information” means information that identifies a living individual (including without limitation name, postal address, telephone number, email address, or personal financial account information).

“Data” means any and all data, information, and materials input or transmitted by Investors, Firm or Firm’s users or on behalf of Investors, Firm or Firm’s users to Application.

“Investor” means an individual or other third party, including any authorized legal representative of such individual, in connection with whom a Firm has requested that CoinCalcu make Application available.

“Relationship Data” means information that CoinCalcu collects during the registration, activation and maintenance of Firm’s and users’ accounts. Such information may include, without limitation, names and contact details of Firm personnel or users involved in maintaining or using Application and other services.

1. Personal Information

1.1 CoinCalcu collects certain Relationship Data about Firm and users, which may include Personal Information about Firm’s personnel or users involved in maintaining or using Application, including names and contact details.

1.2 Firm and Firm’s users may use Application to process and store Data that includes, without limitation, (i) Personal Information related to Firm’s personnel, end users, or investors, and (ii) other individuals. Data may include, but not be limited to, transactions, positions, and other investor-specific account data.

2. Use of Personal Information

2.1 CoinCalcu uses Personal Information contained in Relationship Data to deliver and manage services and to provide support, improve service offerings, offer other services, and for CoinCalcu’s internal analysis purposes.

2.2 CoinCalcu uses Personal Information contained in Data to provide services through Application, and in accordance with this Statement and the other Agreements.

3. Sharing of Personal Information

3.1 CoinCalcu may share Personal Information with its affiliates and third-party service providers who provide services to CoinCalcu in connection with Application. These services may include, but not be limited to, data hosting, data analysis, customer support, payment processing, information technology and related infrastructure provision, auditing and other services.

3.2 CoinCalcu may also use or share Personal Information as CoinCalcu believes to be necessary or appropriate: (a) under applicable law, including laws outside Firm’s and users’ country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities and regulatory bodies including public and government authorities and regulatory bodies outside Firm’s and users’ country of residence; (d) to enforce CoinCalcu’s Agreements and other applicable terms and conditions; (e) to protect CoinCalcu’s operations or those of any of CoinCalcu’s affiliates or others; (f) to protect CoinCalcu’s rights, privacy, safety or property, and/or that of CoinCalcu’s affiliates, Firm, Application users or others; (g) to allow CoinCalcu to pursue available remedies or limit the damages that CoinCalcu may sustain; or (h) in connection with a corporate reorganization, merger, sale, assignment, transfer, or other disposition of any portion of CoinCalcu’s or CoinCalcu Software, Inc’s (its parent company) business, assets or stock.

4. Other Information

CoinCalcu may also collect other information in providing services through Application (“Other Information”) including, but not limited to:

4.1 CoinCalcu collects data about users’ access to and usage of Application, including IP addresses used to access Application, time stamps, clickstream information, and details of activity on Application, as well as system performance data and other information related to hardware or software used by users in connection with Application (“Usage Data”). This also may include information CoinCalcu collects through:

1. Browsers: Certain information is collected by most browsers and/or web servers, such as a user’s computer’s Media Access Control (MAC) address, device type, screen resolution, operating system version and Internet browser type and version, and general geographic location.
2. Cookies: CoinCalcu and its service providers use cookies and other technologies for security purposes, to facilitate navigation, display information more effectively, and to personalize users’ experience on Application. CoinCalcu and its service providers may also use cookies for online tracking purposes and may provide cookie information to a service provider who performs analytics relating to website usage. If users do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows users to decline cookies. A user may also wish to refer http://www.allaboutcookies.org for more information about cookies. However, if a user does not accept certain cookies, such user may experience some inconvenience in the use of Application and, and in some instances, may not be able to use any of the functions and features offered by Application.
3. Web beacons and other similar technologies: CoinCalcu may also use technology, such as web beacons, to track the navigation paths used by users of Application and transmit that information to third-party service providers who assist CoinCalcu in improving the relevance of the information that CoinCalcu provide to its visitors.
4. CoinCalcu does not respond to “Do Not Track” browser signals or other mechanisms.

4.2 CoinCalcu may collect any other information that does not personally identify a user, such as their country location. CoinCalcu may also aggregate any information, including Personal Information, so that the end product does not personally identify a user or any other individual, such as by using Personal Information to calculate the percentage of users who use CoinCalcu in a particular geographic region. If Other Information does not personally identify a user, CoinCalcu may use and disclose such information for any purpose.

If Other Information is correlated with Personal Information, or if CoinCalcu combines any Other Information with Personal Information, CoinCalcu will treat the combined information as Personal Information as long as it is combined and will only use such information to provide the services in accordance with this Statement and the other Agreements.

5. Data Security

CoinCalcu maintains administrative, technical, physical, and procedural safeguards reasonably intended to protect the security of Personal Information and Account Data maintained in Application.

6. Location of Personal Information

Data, which may include Personal Information, may be stored and processed in any country where CoinCalcu has facilities or service providers, including but not limited to, the United States or Ireland, where applicable law may have different data protection rules than a user’s country of residence. CoinCalcu may store and process such Personal Information outside the country where a user resides to provide Application, and in accordance with this Data Use Statement and other agreements with Firm. 8. Updates to this Data Use Statement

CoinCalcu may modify this Data Use Statement from time to time pursuant to the process set out in the Application Terms of Use for making changes to such Application Terms of Use. Please take a look at the “Last Updated” legend at the top of this page to see when this Statement was last revised. Any changes to this Statement will become effective as set forth in the Application Terms of Use.
